Affiliate terms of service

By joining the EXM Affiliate Program, you agree to the following Terms of Service. These terms form a legally binding agreement between you (“Affiliate”) and EXM Tweaks (“EXM”, “we”, “us”).


1. Eligibility

  • You must provide accurate, complete, and up-to-date legal and payout information.

  • EXM reserves the right to approve, reject, suspend, or remove any affiliate at its sole discretion.

2. Commissions

  • Commission rates are defined by your assigned affiliate tier and displayed in official EXM affiliate channels or the affiliate dashboard.

  • Commissions are calculated on net revenue only, after:

    • VAT or sales tax

    • Payment processing fees

    • Refunds

    • Chargebacks

  • Only approved and non-refunded transactions qualify for commission.

3. Payouts & Payment Schedule

  • The minimum payout threshold is €50.00.

  • Payouts are generated automatically once your approved balance meets or exceeds this threshold.

  • Payouts follow a NET-15 schedule, meaning commissions earned in a given month are paid 15 days after the end of that month.

  • If the payout threshold is not reached, earnings roll over to the next payout period.

4. Supported Payout Methods

Supported payout methods include:

  • PayPal

  • Wise

  • Wire / SWIFT transfer

  • Local bank transfer

  • Cryptocurrency payouts

Availability of payout methods may vary depending on country and regulatory requirements.

5. Cryptocurrency Payouts

  • Crypto payouts are subject to network fees and blockchain confirmation times.

  • Additional cryptocurrencies may be added at EXM’s discretion.

6. Payout Processing

  • Payouts are handled directly through EXM’s affiliate platform.

  • EXM does not manually calculate commissions.

  • Affiliates are responsible for ensuring payout details are correct and up to date.

  • EXM is not liable for failed or delayed payouts caused by incorrect information or external payment providers.

  • Affiliates are fully responsible for declaring and paying any applicable taxes in their jurisdiction.

7. Creator Referrals & Override Commissions

  • Affiliates may be eligible for override commissions when referring other creators or affiliates.

  • Override commissions apply only if explicitly approved by EXM.

  • Rates, duration, and conditions are determined solely by EXM.

  • Abuse or manipulation of the referral system results in removal from the program.

8. Promotional Keys & Rewards

  • Promotional keys are provided strictly for community giveaways or promotional use.

  • Keys may not be sold, traded, exchanged, or monetized.

  • Abuse of keys results in immediate termination and forfeiture of unpaid commissions.

9. Tracking & Attribution

  • All referrals must occur through your unique affiliate link.

  • Tracking may be affected by cookies, ad blockers, VPNs, browser privacy settings, or downtime.

  • EXM is not responsible for lost or untracked conversions.

  • EXM’s determination of referral validity is final.

10. Promotion Restrictions

Affiliates may not:

  • Use spam, bots, fake accounts, or traffic farms.

  • Purchase incentivized or misleading traffic.

  • Bid on EXM trademarks or brand keywords in paid ads.

  • Impersonate EXM staff or official representatives.

  • Make false, misleading, or unverified claims, including fake benchmarks or guaranteed results.

  • Promote EXM in a deceptive or defamatory manner.

11. Brand Usage

  • Affiliates may use official EXM branding and marketing assets provided by EXM.

  • Branding may not be altered or used in a way that harms the EXM brand.

  • Custom or modified assets require prior approval.

12. Fraud & Audits

  • Fraud includes fake sign-ups, chargeback abuse, free trial abuse, or violations of the EXM User Agreement.

  • Confirmed fraud results in permanent removal and forfeiture of unpaid commissions.

  • EXM reserves the right to audit affiliate activity and withhold commissions during investigations.

13. Termination

  • Either party may terminate this agreement at any time.

  • EXM may terminate immediately for violations, fraud, or brand harm.

  • Upon termination, affiliates must cease using EXM branding and links.

  • Invalid or fraudulent commissions will not be paid.

14. Independent Contractor Status

  • Affiliates act as independent contractors.

  • No employment, partnership, agency, or joint venture is created unless explicitly agreed in writing.

15. Liability & Indemnification

  • EXM is not liable for indirect, incidental, or consequential damages.

  • EXM’s total liability is limited to commissions paid within the last six months.

  • Affiliates agree to indemnify EXM against claims arising from their promotions or actions.

16. Governing Law

  • These terms are governed by the laws of the Slovak Republic.

  • Any disputes will be resolved by the courts of Slovakia.

17. Changes to Terms

  • EXM may update these terms at any time.

  • Material changes will be communicated via Discord, email, or the affiliate dashboard.

  • Continued participation constitutes acceptance of updated terms.

By continuing in the EXM Affiliate Program, you confirm you have read and agreed to these terms.
